Power Agent® Board Affiliate Program: Terms of Service

Welcome to the Power Agent® Board Affiliate Program! These Terms of Service (“Terms”) govern your participation in the program offered by Darryl Davis Seminars, Inc. (“we,” “us,” “our”).

By applying to or participating in the Affiliate Program, you agree to the following:

1. Eligibility

The Affiliate Program is open exclusively to real estate associations, REALTOR® boards, and similar professional organizations. We reserve the right to approve or deny any application at our sole discretion.

2. Commission Structure

Affiliates receive a $10/month commission per active member referred through their unique link.

Commissions are paid monthly, typically within 30 days following the end of each calendar month, via the payment method on file.

3. Referral Tracking

Each board is issued a unique referral link. Only registrations completed through that link will be eligible for commissions. We are not responsible for missed referrals due to incorrect or altered links.

4. Marketing & Brand Use

Affiliates are granted permission to use provided co-branded materials for the sole purpose of promoting the Power Agent® Program. Any additional use of the Darryl Davis Seminars or Power Agent® brand (logos, trademarks, etc.) must be approved in writing.

Affiliates may not:

  • Make false or misleading claims about the program

  • Use unapproved language, branding, or sales tactics

  • Promote the program in a way that could damage our reputation or mislead consumers

5. Program Management & Support

We provide:

  • A referral partner dashboard to track sign-ups and commissions

  • Ongoing support and onboarding for referred members

  • Co-branded marketing materials to support your promotions

We manage all billing, customer support, and cancellations directly with referred members.

6. Changes to the Program

We reserve the right to modify or terminate the Affiliate Program, including commission rates or payout structures, at any time with 30 days’ written notice. Continued participation in the program constitutes acceptance of any changes.

7. Termination

We may terminate your participation in the Affiliate Program at any time for violation of these Terms, misuse of materials, or behavior deemed harmful to the Power Agent® brand.

You may also terminate participation at any time by notifying us in writing. Commissions will cease after termination unless otherwise agreed upon in writing.

8. Limitation of Liability

We shall not be liable for any indirect, incidental, or consequential damages arising out of your participation in the Affiliate Program. Our total liability shall not exceed the total commissions paid to you in the prior 12 months.

9. Independent Relationship

Nothing in this agreement shall be construed to create a partnership, joint venture, or employer-employee relationship between the parties. You are participating as an independent entity and not authorized to bind us in any manner.

10. Governing Law

These Terms shall be governed by the laws of the State of New York, without regard to its conflict of law provisions.
